Moody Beach is a landmark case in Maine: under the 1989 Bell v. Town of Wells decision, oceanfront owners hold title to the dry sand down to the mean low-water mark. The public retains rights only for "fishing, fowling, and navigation."
In practice, the community welcomes respectful recreation — walking, wading, setting up chairs on the wet sand at lower tides. Keep it simple: stay near the water line, pack out everything you bring, and be mindful that the dune grass and dry sand above the tide line is private property.
